Speech Studio Ltd. (“Speech Studio”, “we”, “us” “our”) is committed to being a responsible custodian of the information you provide to us and the information we collect as a data controller and to using the personal data we hold in accordance with applicable laws.

The Cayman Data Protection Act (the “DPA”) sets out the basis upon which an individual’s personal data can be obtained and used. The purpose of this Privacy Notice (“Notice”) is to explain how Speech Studio and our clinicians will manage, in compliance with the DPA, any personal data and sensitive personal data that we collect about you when you contact us or use our services including:

  • The types of information, including personal data, we may collect;
  • How we may use and share the information we collect;
  • The legal grounds for using personal data;
  • Retention of the information we collect;
  • Third party services and content;
  • Your choices and rights in respect of the information we hold;
  • How to contact us; and
  • Changes to this Notice.

2. WHAT INFORMATION DO WE COLLECT?

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our services, when you participate in activities on our Website [ https://speechstudio.com ] or when you contact us.

The personal information that we collect depends on the context of your interactions with us and with our Website, the choices you make and the services and features you use. The personal information we collect may include the following:

  • Name and date of birth
  • Postal address, email address and telephone number
  • Emergency contact details including next of kin
  • Background referral details
  • Clinician details and those of other professionals involved in your care
  • Details of your appointments, clinic visits, medications administered etc.
  • Records about your health, treatment and care
  • Results of investigations, such as laboratory tests
  • Information from other health professionals
  • Medical insurance details and
  • Voice and video recordings of therapy sessions

3. WHO PROCESSES PERSONAL DATA?

In order to support your care, Speech Studio maintains records about you. The records may be processed by any of the following, both internally or at facilities we are associated with:

  • Clinicians
  • Our reception team
  • Our accounts team
  • Individuals who maintain our medical records

In certain circumstances, your personal data may be processed by third party service providers including information technology support providers and medical billing companies.

The processing of your personal information is necessary. We would not be able to provide our services to you without having access to your personal information.

4. HOW DO WE USE THE INFORMATION WE HOLD ABOUT YOU?

To ensure you are receiving care according to your clinical needs, we process personal data relating to your health and we may use information about you to enable us to arrange appointments with the appropriate clinician(s) and/or other facility for consultation, investigations and/or treatment.

If you have been referred to us by another medical professional, we may disclose details of your consultation/investigations/treatment to them where appropriate. You can ask for some information not to be shared but this may result in the delivery of your care being less efficient.

We will never market our services to you or pass on your information to a third party for marketing purposes.

Each time we process your data we must have a legal justification for doing so. Generally, the grounds for doing so will be as follows:

  • To set you up as a patient on our systems so that you can enter a contract with us to receive services from us;
  • To provide you with our services;
  • To communicate with you and resolve any queries, concerns or complaints you may have;
  • To communicate with other professionals involved in your care;
  • To comply with our regulatory obligations;
  • For payment settlement purposes;
  • For appropriate business needs;

5. THE LEGAL GROUNDS FOR USING PERSONAL DATA

We may process or share your data that we hold based on the following legal basis:

  • Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.
  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.
  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

6. RETENTION OF THE INFORMATION WE COLLECT

We retain the information we collect for no longer than is reasonably necessary to fulfil the purposes for which we collect the information and to comply with our legal obligations.

7. YOUR CHOICES AND RIGHTS IN RESPECT OF THE INFORMATION WE HOLD

Under local law, you may have certain rights regarding your personal information that we have collected. You have the right to request (i) access to your personal information, (ii) rectification or erasure of personal information, (iii) restriction of processing concerning you, and (iv) objection to processing that is based upon our legitimate interests. Your ability to exercise these rights will depend on a number of factors and, in some instances, we will not be able to comply with your request, for example because we have legitimate grounds for not doing so or where the right does not apply to the particular information we hold on you. If you would like to discuss or exercise the rights you may have, you can contact us through the methods stated below.

It is important that any personal information we hold about you is accurate and current. Please keep us informed if your personal information changes whilst we continue to retain such information. If you provide information for another person you will need to direct them to this Notice. We encourage you to contact us to update or correct your information if it changes or if you believe that any information that we have collected about you is inaccurate or out of date. You can also ask us to see what personal data we hold about you and to erase your personal data if it is no longer required. You may also tell us if you object to our use of your personal data.

We will respond to any such written requests as soon as is reasonably practicable and in any event within statutory time limits, which is typically 30 days but may be extended where your request is complex. We will be better able to respond quickly to smaller, targeted requests for information. If the request is manifestly unfounded or excessive we may ask you to reconsider or charge a proportionate fee, but only where data protection law allows this.

You should be aware that certain data is exempt from the right of access. This may include information which identifies other individuals, or information which is subject to legal privilege. We are also not required to disclose any reference given or received by the school for the purposes of the education, training or employment of any individual.

8. HOW WE MAY USE AND SHARE THE INFORMATION WE COLLECT

We collect most of the personal data we process directly from the individual concerned. In some cases, we collect data from third parties or from publicly available resources.

Personal data held by us is processed by appropriate members of staff for the purposes for which the data was provided, as described below. We take appropriate technical and organisational steps to ensure the security of personal data about individuals.

We may transfer information to countries outside the Cayman Islands which may have data protection laws and regulations that differ. Personal data will not be transferred outside the Cayman Islands unless that personal data will be afforded an equivalent level of protection.

We may store the information we collect in on our servers (both cloud based or in servers located in secure data centres within the Cayman Islands but also in countries where we or our service providers have facilities. Some of our systems are provided by third parties. In these circumstances contractual and other technical and security safeguards will be put in place with the third party service provider, including to ensure that personal data is processed only in accordance with this Notice.

However, no information system can be 100% secure. We cannot guarantee the absolute security of your information. Moreover, we are not responsible for the security of information you transmit to us over networks that we do not control, including the internet and wireless networks.
